1. General terms and conditions
The following terms and conditions apply between you and HhAM (ABN: 36 270 800 472) every time you use or engage with any of our online services in any way, where online services refers to any of our social media pages (including, but not limited to our official facebook, instagram and twitter pages) and this online store (domain address www.hham.com.au, also referred to as “this online store” and “our online store” in this document ) , henceforth collectively referred to as “online services”, or place an order either via this online store, telephone, e-mail, live chat or in person.
HhAM does not guarantee that all products presented on our online services are in stock or are available for purchase. HhAM reserves its right to stop selling a product.
Orders can only be placed by persons that are 18 years or older.
HhAM reserves the right to revise the Terms and Conditions at any time without notice and will always display the latest update on this online store. The terms and conditions in effect at the time you place your order are the terms and conditions which will be valid for this order. Users are responsible for keeping themselves updated with such changes. You are advised to keep a copy of these Terms and Conditions for future reference.
The language of the Terms and Conditions is English. If there is any conflict, ambiguity, or discrepancy between this English version and a version in another language, this version shall always prevail.
The most recent update of the Terms and Conditions of HhAM was made on 28 July 2016.
HhAM reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Furthermore, you may be subject to prosecution if you violate the restriction of password-protected areas of our online services.

3. My account
When you place an order on our online store an account will be created in our customer management system. The only information that will be stored is the information you provide to your order such as shipping and billing address as well as email address. If you create an account yourself you will be able to choose a password with which you can log in to your account online and view your order history and track your order. If you do not create an account yourself you can always contact email@example.com and we can provide you with a password to log in. If you would like to delete an account you can also contact firstname.lastname@example.org and the customer care team will assist you. Due to security purposes, we do not offer the option to store credit card details on your account and do not store credit card information on our online services.
4. Order confirmation
You will receive an order confirmation email to your nominated email address once you submit your order via our online store. This email will include your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order.
5. Acceptance and shipping confirmation
Once your order has been processed and accepted by HhAM, you will be notified of the acceptance of your order via a confirmation email which will include delivery tracking details for you to trace your order. We reserve the right to grant or withhold acceptance of any order, and may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. The shipping confirmation is our acceptance of your order.
Please remember that HhAM does not guarantee that all products presented on our online store are in stock at the time of your order. In the situation the product you order is unavailable we will arrange to contact you shortly, by phone or by e-mail to advise you of this. If we already have received payment for such product we will refund you the amount of the purchase in the same mode as which the payment for said product was made.
6. Variation in product appearance
HhAM’s goal is to display and describe all of our products on our online store as accurately as possible. However, please note that due to the variability in the color settings of your computer, laptop, mobile or tablet device, the colors of the products shown in the images on our online store can differ somewhat from their actual colors. HhAM cannot be held responsible for any such discrepancy, however we are happy to accept order returns for whatever reason, according to our returns policy.
7. Product pricing
The prices shown on the Website include GST. HhAM reserves the right to make adjustments to product prices and delivery costs shown our online store at any time and HhAM is not bound by the price advertised until your order has been accepted, as indicated by the sending of your shipping confirmation email. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. HhAM always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase in the same payment method as was originally used by you. HhAM may cancel the order even if it has been accepted by HhAM under the condition that you realize or should have realized that the price information was incorrect.
8. Direct Donate
Transaction fees will be deducted from any Direct Donate purchases made on the online store. These are determined by the Shopify hosting platform and are not determined by HhAM. HhAM does not re-invest any portion of Direct Donate purchases into paying its expenses or retain any portion of Direct Donate for any other reason. Excluding pre-set credit card and paypall transaction fees, all Direct Donate purchases are donated to charity partners, as specified on our online store.
9. Shipping and Delivery
HhAM offers complimentary standard delivery for all Australian orders serviced by Australia Post. HhAM reserves the right to change this policy at any time without prior notice, and will update delivery cost and policy conditions in this situation.
We post our domestic orders via Australia Post. Delivery time from approval of your order varies depending upon your delivery address, but our goal is always to have our products shipped out as soon as possible. Our most recent records indicate that you can normally expect your product to arrive between 2-7 business days. HhAM does not take any responsibility for delays in delivery of orders caused by circumstances outside our control, including but not limited to delays in processing and delivery of your order by Australia Post.
Orders received on weekends and public holidays will be processed the next business day. Shipping and delivery is not covered by insurance.
Please make sure you provide your email address when placing your order as we will email you your tracking number once your order has been sent.
If you would like your order delivered faster, you can select express shipping for your order. Costs for express delivery can be calculated using the calculator provided at checkout or on our Shipping and Returns Page.
If you would like orders shipped to an address different from your billing address, please select "Use a Different Billing Address" at the checkout point and specify the billing address you would like your order billed to. We also offer delivery to your nearest Australia Post Office. If you would like to pick up your order from an Australian Post Office, please indicate this and the address the Post Office when placing your order. Unfortunately we are not able to accept PO BOX addresses.
We also offer international deliveries to all countries serviced by international Australia Post. For delivery costs of international orders, please use our delivery cost calculator on our Shipping and Returns page or at checkout, specifying which country you would like your order shipped to, as well as the mode of delivery you would like your order shipped by. Delivery times vary dependent upon the destination of your order, however most recent estimates are between approximately 7-14 days from order approval for standard airmail. If you would like your order sooner, please feel free to select an expedited delivery option from our calculator when estimating shipping costs and when placing your order.
Your order will be delivered to the address you provide as your shipping/delivery address.
While we always endeavour to get your order to you as promptly as possible, delivery times indicated on our online services are provided as a guide only and are relevant from the date of dispatch. These delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If HhAM fails to deliver within 30 days, you may have the right to cancel the purchase.
All orders are fully traceable on our online store by logging in to My account. Click “My Orders” and fill in the tracking number for updated information about your shipment. Alternatively, you can trace your order using your tracking number and visiting www.australiapost.com.au .
10. Returns policy
HhAM offers a 30 day return period for domestic and international orders with full money back refund policy provided your product has not been worn and is returned in its original condition, including product packaging, which is considered part of the product. All orders are inspected and documented prior to shipping. If the products’ value has diminished due to your handling of the products to a greater extent than is necessary in order to ascertain its characteristics or function, or for any other reason, you have an obligation to reimburse us. Thus, HhAM then has the right to withhold such amount of the refund. Please make sure the product you wish to refund is in the exact same condition as when you received them, with any tags and seals attached as they were in their original condition. HhAM reserves the right to refuse refund if returns are not made within the 30 day return period from receipt of your order.Return shipping will be free for both international and domestic purchases for the month of August 2016. This is subject to change at any time, for either or both domestic and international orders and HhAM reserves the right to amend its return policy at any time. Changes to return policy will be reflected in these Terms and Conditions as well as in the Shipping and Returns page.
Returns should be arranged via email to our customer support group at email@example.com. You will be required to quote your order and invoice number within the 30 day return period from receipt of your order. Refunds will be credited to the same payment method used to make the original order.
Products must be returned in their original undamaged product package and shipped in the same postal box (or an equivalent purchased at the customer's expense if the original postal box is not re-usable for whatever reason). Returns should be addressed to HhAM, PO Box 133, Doncaster Road, North Balwyn, VIC, Australia, 3104.
If there are any problems with the quality of your product please contact firstname.lastname@example.org to arrange free return of your order and a full refund or exchange. Products are deemed faulty if they are damaged on arrival or where a manufacturing fault occurs within 6 months of purchase. Wear and tear damage is not included as a product fault.
If you find that your product is faulty upon arrival, please contact customer support at email@example.com to arrange free return and a full refund within 30 days. If you discover a fault after this time, but within 6 months of purchase, you can still return it. We will offer to repair faults where possible, or will send you a replacement if the product cannot be repaired and the same product is still in stock. If your product cannot be repaired and is no longer in stock, you will be credited a full refund.
11. Purchasing a product: payment methodsThe following payments are accepted.

Payment can be made by the following credit cards: Visa, Mastercard and American Express. HhAM does not accept debit cards or direct debit. The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once HhAM has sent you the order confirmation email. We do our best to make the website as secure as possible. All credit card transactions on the website are processed using a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by HhAM. You confirm that the credit card that is being used is yours or that you have been specifically authorized by the owner of the credit card to use it. All credit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to HhAM, your order will be cancelled. HhAM does not take any responsibility or liability for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.
When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.
12. Copyright, intellectual property and trademarks
HhAM owns or has license to the Copyright of the documents provided in this site (including, without limitation, the trademarks of HhAM, graphics, text, photos, designs, logos, icons, images, multimedia, data and software). You are authorized to use this material only for personal, non-commercial purposes. You are prohibited from charging anyone for use of the material, and are prohibited from modifying the material in anyway without prior written permission of the copyright owner. You may not publish, duplicate or otherwise distribute the material to others without prior written consent from HhAM.
Except as expressly stated in this legal notice, no rights or licenses to the material, or any portion thereof, shall be granted or implied.

HhAM's trademarks include the HhAM name; our logo is in the process of trademark approval. Please note that your use of any of our online services does not grant you any rights to use our trademarks. HhAM reserves the right to pursue appropriate legal action for infringement of trademark and intellectual property laws that relate to trademarks and intellectual property owned by or licensed to HhAM.
HhAM uses Shopify and Stripe to maintain commercially reasonable administrative, technical and physical procedures to protect all the personal information regarding you and your customers that is stored in our servers from unauthorized access and accidental loss or modification. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use such personal information for improper purposes. You acknowledge that you provide this personal information regarding you and your customers at your own risk.
16. Resale policy
You are not permitted to resale any product you purchase from HhAM via our online store, telephone, e-mail, live chat or in person. All orders must be for personal use only. By placing an order via our online store, telephone, email, live chat or in person, you certify that you are purchasing products for your own personal use and not for resale and that you accept the Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.
17. Information on the website
While HhAM strives to display the correct texts, images and pricing on the site and online shop, errors may occur and we cannot promise that the content of the site is free of inaccuracies or typographical errors or guarantee that all information is up-to-date. HhAM may, at any time, amend the content of the site. Parts of the services provided through our online services are maintained by third party operators and HhAM cannot be held responsible for any errors resulting from their activities. HhAM cannot be held responsible for any damage caused from using the site or for any damage caused by not being able to use the site and cannot guarantee problem-free, uninterrupted, and secure access to the site.
Our online services may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.
19. HhAM’s responsibility
HhAM’s liabilities to you are limited in each separate case to these Terms and Conditions unless otherwise is stipulated by law, and will never exceed your total purchase amount for each order. In no case whatsoever will HhAM assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. In case of force majeure, HhAM’s obligations will be suspended. The contract between you and HhAM can, in such cases, be partially or fully terminated by yourself or by HhAM.
